Dear Friends,

The reason this activist list got started was to do something about “The Rod”, a device designed specifically to whip babies and children. See http://www.stoptherod.net/rod-petition.html This device is no longer being made and sold, however there are others such as this baby-whipping device http://www.stoptherod.net/child-training-resources-images.html

Earlier this year we found a Republican US Representative (Nancy Johnson - CT) to cosponsor legislation against these devices, along with my US Representative, Ed Markey. However, both offices said they were overwhelmed with other issues. So my lawyer, with several setbacks because of health problems, has written up the legislation to ban these devices in the US, to help get this process moving.

I sent the legislation to Markey’s office last week. Like usual, I haven’t gotten any response. I need your help to get their attention!!

A BILL PROHIBITING THE MARKETING OF DEVICES FOR THE EXPRESS PURPOSE OF INFLICTING PHYSICAL PAIN ON CHILDREN

Be it enacted by the Senate and House of Representatives of the United States of America in Congress, assembled, that:

SECTION 1. Title 15 of the United States Code, as appearing in the ___ Official Edition, is hereby amended by inserting after Section 2057b, a new Section 2057c, as follows:

(a) In general

Except as provided in subsection (b) of this section, hitting and whipping devices shall be considered a banned hazardous product under section 2057 of this title. The Congress finds that such products present an unreasonable risk of injury and no feasible consumer product safety standard under this chapter would adequately protect the public from the unreasonable risk of injury associated with such products. The Commission shall, in accordance with section 2058 of this title, promulgate a rule declaring such products banned hazardous products.

(b) Lawful purposes

For the purposes of section 2057 of this title, it shall not be unlawful for any person to manufacture for sale, offer for sale, distribute in commerce, or import into the United States hitting and whipping devices for any commercial purpose or for any purpose involving use of the product between and among consenting adults.

(c) Definitions

For purposes of this section:

(1) The term “hitting and whipping devices” includes devices for inflicting physical pain, including, but not limited to, whips, paddles, and electroshock devices, including those that are manufactured for sale, offered for sale, distributed in commerce, imported into the United States, or marketed for use on minors.

(2) The term “commercial purpose” means any commercial purpose other than for the production of consumer products containing hitting and whipping devices.

(d) Effective date

This section shall take effect 90 days after its enactment.
